Trademark Policy & Reporting

Parsafy AI Inc. is committed to respecting intellectual property rights, including trademark law, and expects all users of our platform to do the same. This page explains Parsafy's trademark policy, what constitutes a violation, how to report suspected violations, and how we enforce this policy.

This policy covers trademark-related concerns only. For copyright infringement, please refer to our Copyright Policy & Reporting page. For impersonation concerns that do not involve trademark rights, please refer to our Community Guidelines.

Parsafy is a free-speech platform. Not all references to, or uses of, a third-party trademark constitute a violation of this policy. We evaluate trademark reports carefully and do not remove content or take enforcement action based solely on the existence of a trademark registration.

📋 Overview

Parsafy respects the trademark rights of third parties and enforces this policy to prevent unauthorized or confusing use of trademarks on the platform. At the same time, we recognize that many uses of trademarks — including commentary, criticism, parody, comparative advertising, and nominative fair use — are lawful and protected, and do not constitute a violation of this policy.

Trademark violation reports are investigated only when submitted by the trademark holder or their authorized representative, such as legal counsel or a brand representative. Parsafy does not proactively search for trademark violations. If you believe your trademark is being misused on Parsafy, you must submit a formal report.

Note: Parsafy may share your name and the details of your report with the account holder alleged to be in violation, as part of our commitment to fair process for all parties.

™️ What Is a Trademark?

A trademark is a word, name, logo, phrase, design, symbol, or combination thereof that identifies and distinguishes the source of goods or services of one party from those of others. Trademark rights are designed to prevent consumer confusion about the source or sponsorship of products and services in the marketplace.

Trademark rights can arise in two ways:

  • Registered marks — marks registered with a national trademark office (such as the USPTO in the United States), which enjoy presumptive legal protection under 15 U.S.C. § 1114 of the Lanham Act.
  • Unregistered (common law) marks — marks that have not been formally registered but have acquired distinctiveness through use in commerce, which may be protected under 15 U.S.C. § 1125(a) of the Lanham Act.

The strength and geographic scope of trademark rights vary based on registration status, the nature of the mark, the territory in which it is used, and the categories of goods or services it covers. If you are uncertain whether you hold trademark rights in a particular mark, consult a qualified attorney. Parsafy cannot provide legal advice.

⚖️ What Is — and Is Not — a Trademark Violation

Using another party's trademark in a manner that is likely to mislead or confuse consumers about your affiliation with, or endorsement by, the trademark holder may constitute a violation of Parsafy's trademark policy. However, many uses of trademarks are lawful and do not violate this policy.

✗ Likely Violations

  • Impersonating a brand or business by using their trademark in a username, display name, or profile in a way that causes consumer confusion.
  • Using a trademark to falsely imply affiliation with, sponsorship by, or endorsement from the trademark holder.
  • Selling counterfeit goods or services using another party's trademark.
  • Operating a fake customer service account or official brand page using another party's trademark without authorization.
  • Using a trademark in a way that is likely to divert customers or damage the reputation of the mark holder.

✓ Generally Not Violations

  • Nominative fair use — referring to a trademark to identify the actual brand, product, or service (e.g., "I bought a pair of Nike shoes").
  • Commentary, criticism, or satire of a brand or its products, provided it is clearly not affiliated with or endorsed by the brand.
  • Comparative advertising that truthfully compares products or services.
  • Fan accounts or parody accounts, provided they are clearly identified as unofficial and not affiliated with the brand.
  • Academic, educational, or journalistic reference to a trademark.
  • Use of a mark in a region or for goods/services entirely outside the scope of the trademark's registration.
💡 Free Speech Note: Parsafy is a free-speech platform. Commentary, criticism, and parody involving trademarks are generally protected expression. We will not remove content solely because it references a trademark — we evaluate whether the use is genuinely likely to cause consumer confusion or harm the mark holder's rights.

🛡️ Parsafy's Own Trademarks

The Parsafy name, logo, wordmark, and all associated product names — including ViraFrame, Tellefy, Guilda, and Collaboration — are trademarks or service marks of Parsafy AI Inc. All rights reserved.

You may not use Parsafy's trademarks without our prior written consent, except as expressly permitted by our Brand Guidelines. Unauthorized use of Parsafy's trademarks — including in usernames, domain names, app names, business names, or promotional materials — may constitute trademark infringement and may result in legal action.

Permitted uses of Parsafy's trademarks include:

  • Nominative references to Parsafy when accurately describing the platform (e.g., "I post content on Parsafy").
  • Press and media references in accordance with our Brand Guidelines.
  • Legitimate criticism, commentary, or parody of Parsafy, provided it is clearly not affiliated with or endorsed by Parsafy AI Inc.

🤔 Before You Submit a Trademark Report

Confirm You Are the Rights Holder

Trademark reports are accepted only from the trademark holder or their authorized representative. Before filing, confirm that you own the mark at issue or have been expressly authorized by the owner to act on their behalf. Reporting a trademark violation on behalf of a third party without authorization is not permitted and may result in your report being rejected.

Evaluate Whether a Violation Has Actually Occurred

To establish trademark infringement under the Lanham Act, you must be able to demonstrate all three of the following elements:

You have a valid and legally protectable mark — either a registered mark under 15 U.S.C. § 1114 or an unregistered mark that has acquired distinctiveness in commerce under 15 U.S.C. § 1125(a).

You own the mark — you are the trademark holder or an authorized representative with standing to enforce the mark.

The use of the mark to identify goods or services causes a likelihood of confusion among consumers as to the source, sponsorship, or affiliation of those goods or services.

If you cannot establish all three elements, your report may not meet the threshold for enforcement action. Consider consulting a qualified attorney before filing.

Consider Fair Use and Protected Expression

Before reporting, assess whether the use you have identified may qualify as fair use, commentary, criticism, parody, or nominative use. These uses are generally protected and do not constitute trademark infringement. Filing a bad-faith trademark report may have legal consequences for the reporter.

⚠️ Legal liability: Filing false or bad-faith trademark reports may expose you to legal liability, including claims of abuse of process, tortious interference, or violation of platform policies. Parsafy reserves the right to take action against users or third parties who submit repeated or frivolous trademark complaints.

📝 Required Information for a Trademark Report

To process your trademark report, Parsafy requires the following information. Incomplete reports may be delayed or rejected, and we may contact you for additional details.

  1. Your Identity & Authorization
    Your full legal name, title, company name (if applicable), and a clear statement confirming that you are the trademark holder or are authorized to act on their behalf.
  2. Contact Information
    Your email address, mailing address, and telephone number. This information may be shared with the account holder named in your report as part of our fair process obligations.
  3. Identification of the Trademark
    The specific trademark at issue (word, logo, phrase, or design). If the mark is registered, provide the registration number and the jurisdiction of registration (e.g., USPTO Registration No. XXXXXXXX). If the mark is unregistered, describe how and where you have used it in commerce and for how long.
  4. Goods or Services Covered
    The categories of goods or services for which the mark is registered or used, and the territories in which you claim rights.
  5. Description of the Alleged Violation
    A clear description of how the mark is being used on Parsafy, why you believe this use constitutes a trademark violation (including your analysis of likelihood of confusion), and why you believe it does not qualify as fair use or other protected expression.
  6. Direct Link to the Infringing Content
    A specific URL or direct link to the content, account, username, or profile element you believe is infringing your trademark. A link to a general profile page is not sufficient.
  7. Signature
    A physical or electronic signature confirming the accuracy of the report and your authority to submit it. Typing your full legal name is acceptable as an electronic signature.

📨 How to Submit a Trademark Report

Only the trademark holder or their authorized representative may file a trademark report. Reports submitted by third parties without authorization will not be investigated.

Privacy note: If Parsafy takes enforcement action based on your report, your name and report details will be shared with the account holder involved in the alleged violation. If you prefer to remain anonymous, you may appoint a legal representative to file on your behalf, using their contact information.

⚙️ How We Process Trademark Reports

Review for Completeness

Upon receipt of your report, Parsafy will review it for completeness and accuracy. Incomplete reports will not be processed. We may contact you for additional information if needed to evaluate your claim.

Substantive Review

Parsafy evaluates trademark reports on their merits, including:

  • Whether the reporter has established standing as the trademark holder or authorized representative.
  • Whether the mark at issue is valid and legally protectable in the relevant jurisdiction and for the relevant goods or services.
  • Whether the use on Parsafy is likely to cause consumer confusion or constitutes a violation of the Lanham Act.
  • Whether the use may be protected as fair use, nominative use, parody, commentary, or other lawful expression.

Parsafy's review of a trademark report does not constitute legal advice and does not create an attorney-client relationship. Our determination is made solely for the purpose of platform policy enforcement.

Notification to Reported User

If Parsafy takes enforcement action, we will notify the affected account holder and provide them with a copy of your report, including your contact information. The affected user will have an opportunity to respond and, where appropriate, to demonstrate that their use is lawful.

💡 Timeline: We process trademark reports in the order received. Complex or disputed reports may require additional time. Filing duplicate reports for the same alleged violation will not accelerate processing and may cause delays.

🚨 Consequences & Enforcement

If an account is found to be in violation of Parsafy's trademark policy following our review, we may take one or more of the following actions depending on the nature and severity of the violation:

First or Minor Violations

For less severe or first-time violations, the account holder may be given an opportunity to remedy the violation — for example, by changing a username, updating a profile, or removing specific content — before further enforcement action is taken.

Egregious or Repeat Violations

In cases of egregious violation — such as deliberate impersonation of a brand, sale of counterfeit goods, or systematic misuse of a trademark — or where a user has previously violated this policy, Parsafy may immediately suspend or permanently terminate the account without prior notice or opportunity to remedy.

Parsafy's enforcement decisions are made at our sole discretion based on the totality of the circumstances. Enforcement action under this policy does not constitute a legal determination of trademark infringement and does not prevent either party from pursuing legal remedies through the courts.

Parsafy reserves the right to cooperate with trademark holders and law enforcement in cases involving counterfeit goods, consumer fraud, or other serious trademark-related violations.

↩️ Appealing a Suspension or Enforcement Action

If your account has been suspended or content has been removed under this trademark policy and you believe the action was taken in error, you may submit an appeal to Parsafy's Legal team.

In your appeal, please include:

  • Your Parsafy username and the email address associated with your account.
  • A clear explanation of why you believe the enforcement action was taken in error.
  • Any evidence supporting your claim that your use of the mark was lawful, including documentation of your own trademark rights, fair use arguments, or evidence that the reported use would not cause consumer confusion.
  • Any relevant correspondence you have had with the original reporter, if applicable.

Parsafy will review each appeal on its merits, taking into account the account's full history and all relevant evidence. Filing an appeal does not guarantee reinstatement. The decision to reinstate an account or restore content is at Parsafy's sole discretion.

⚠️ Important: Do not create a new account to circumvent a suspension while your appeal is pending. Doing so may result in permanent termination of all associated accounts and forfeit your right to appeal.
